Question : Slip & Fall at Residential Property in Wisconsin, US – Need help to recover medical cost from property owner?
My wife fell outside our apt in US this winter due to ice. Snow was never cleaned by property owner which turned into ice and made the walkway very slippery. She had wrist fracture and underwent surgery for that. While my insurance bears part of the medical cost, there are few thousand dollars which my insurance does not cover. I informed about the injury to my property owner. He asked me the docs and he said he will help. My question is
1) Is it a good idea to provide medical info (hospital reports & bills) and let him pay for it?
2) When I don’t sue him, can he still get this paid from his insurance (If insurance is not going to pay him, I doubt if he will pay)?
3) Or is it better to go thru attorney?
I just need the medical cost to be reimbursed. I am not expecting anything more. Please provide your suggestions.

1. if you don’t provide it, he’s not going to pay, for sure.
2. if you don’t sue him, his insurer will only pay if he has “medical payments” on his policy – a no fault coverage, usually limited to $ 1,000 or $ 2,000.
3. The attorney is going to take 30%, and you’re not looking for pain and suffering – so I’d say, save the attorney for a last resort.

Also, if he had a contract with a snow removal guy, then he’s done due diligence – and the person you REALLY need to sue is the snow removal guy.

So if you get volunteer money, great. If not, you might be paying a lot of attorney fees suing the wrong guy.
