I was purchasing this bed & breakfast in upstate NY, once my offer was accepted by seller i went in contract to buy with contingency terms ( like inspection, mortgage approval etc) I had given 10% deposit almost 70k to sellers attorney to be held in trust account then i went in to get the property inspection and i found like lots of problems some were black mold, bad saggy roof, crawl space had water almost 1 ft deep and structural problems after seeking advice with my attorney i decided not to buy this property so my attorney sended a notice to seller attorney based on contingency i am not interested in buying this but seller attorney is not willing to give my 10% deposit back , so i am looking for an advice in this can i file a complaint or report to government service so atleast i could get my deposit back , Please advice!!!!!!!
By the way i use the realtor who was also the listing agent , she is saying once the seller’s attorney says the deal is off she will returned some portion of deposit she is holding?

Its perfectly legal to ask what potential issues a house may have… in fact, i strongly suggest you get a building inspector to go over the house and give you a summary of any structural or pest (termites, etc) damage to the house.

3Question : What is a home sellers liability for recalled appliances?
I just purchased a house and discovered that all of the electric (Cadet Co) wall heaters were recalled and cannot be used. We discovered the defect four days after close of escrow. What is the seller’s liability to fix/replace the defective heaters? The manufacturer is no longer honoring the recall, the home inspector missed the fact that they were recalled and the home warranty company does not cover recalled items. We have asked the seller nicely and they basically told us that it is our problem now and not to bother them. Does anyone know of any legal precedence here? Is the seller on the hook or is it just too bad that we did not catch this before close of escrow?
