I’m a certified nursing assistant and I worked as a PCA (Patient Care Assistant) at an assisted senior living facility. After hours training and working there for three days I decided the job was not for me. They had poor management skills and they don’t treat employers with respect. While I went through hours of training, the manager told me (verbally) that they were not going to pay me for my training hours until I’ve worked 90 days, which was not stated in their employee handouts. I did some research and according to department of lobar, all training hours must be paid by the employer. Since they stated the no pay for training hours until 90 days verbally, is it their words or the labor department’s words? Just to clarify this too, they HAVE to pay me for working the 3 days regardless of anything right?

You didn’t say where you’re performing this work, but assuming it’s in the United States, yes, they have to pay you. You can file a complaint with the Department of Labor.

Talk to your relatives to see if any of them would like to help you start your business by lending money to you. Also go to the bank where you already have an account and speak to a loan officer to see if they can help you. Good Luck!

When purchasing a home with an FHA loan, is the seller required to use a HVAC certified tech to repair heaters? We recently purchased a home and went FHA with our loan. We have recently run into problems with the oil boiler that the seller was supposed to have had fully serviced before we moved in. I’m trying to find the best way to go about getting this unit replaced or properly repaired without taking from my own pocket. We’ve had several techs look at it and agree that it’s been leaking for quite some time. We just moved in the house in June. We did purchase a home warranty but that seems to be a joke as they will only cover $ 1500 of the cost to replace the boiler, we’d be responsible for paying the additional $ 5883!!!

(Please don’t tell me that I should convert…that seems to be what everyone wants to tell me. But that is not the issue right now.) Thanks for any help!!

I would suggest talking to your real estate agent and let them know what is going on with the faulty boiler.
Real Estate office have lawyers that can help or at least advise on issues like this. There should be paragraphs in your purchase agreement that may address this type of issue.

If you did not go thru a real estate office then you should contact a lawyer and see if you have any recourse.
There are free legal services out there that can help point you in the right direction.

Last resort, purchase the new boiler or an upgraded more energy-efficient model and pay over time if you can’t afford the up front cost all at once. The warranty may be able to help with at least the $ 1500.

Shop around too for energy efficient options. This will pay off greatly over the long run.

I am hunting for a new home.. I was approached by several Real Estate Agents and have committed to one of them.

However I was thinking if its required here in Austin to have a Realtor when buying a new home? if not then I dont have to have one for I heard that some Builders would give you the 3% instead if you dont have a Realtor.. Is this true?

It’s not required, but you have to do title searches and such, and that’s kind of a pain without a realtor

Yes, every store everywhere should have a handicapped pamp/ packing space. Especially for doctors and at hospitals.

the fire was caused by a clothes dryer my clothes dryer . It was in the basement the landlord charged me 4 damage and smoke damage but never touch the main floor of the house no paint nothing . he replaced all the windows in the basement had them all cemented up. painted the basrment and replaced 2 door .

Unless you have your own renters insurance, the insurance on the property is to protect the landlord. If he files a claim he may have to pay the deductible but then could come sue you for damages, as could the insurance company for the part that they are stuck with. If it’s a lot of damage, get a lawyer. Also get EVERYTHING in writing. Keep all records of any additional payments you may make to the landlord for damages but most of all, get legal advice. Good luck!

Question : In Florida, is a hot water hookup required in a commercial rental?
I know this sounds odd, but my landlord is somewhat of a slumlord, and i need backup here. The kitchen in the office (and ALL others in the building) has no hot water hooked up. This seems unsanitary to me…please help me with an answer, and provide me a site that can back me up. Thanks

I live in Houston, in an individual own apartment complex(s). We have multi – owners for different units, meaning different owners for units. The main office in this area says everyone in these apartment has to pay for homeowner insurance. By law does can they make us buy insurance for my share of units? or is it mandatory to have home owners insurance? I am wondering because they are threating to throw me out of my own home if I do not buy home owner insurance for the three units that I own. Please help me show proof that I don’t have to buy home owner insurance so that I can fight this. I know I am right, and I am not required by law to buy home owner insurance if I do not want to.
I am owner of this three units. The first owner of these apartment complex can’t afford to keep up with the place so he sold off units to different owners. I do not have loans or mortgages on these units. My contracts when sold to me says nothing about insurance. I am not renting the place.

It is required by your mortgage lender – if you have one.

It can also be required by your condo association or HOA. That’s not a matter of “public law” but it is a contractual obligation that you agreed to when you bought your unit. If you fail to uphold the requirements under your condo agreement, then “they” can indeed take action against you. If you had a single family residence, that would be different.

It’s not a matter of your purchase contracts. It’s a matter of the HOA rules that are incorporated into your deeds by reference. There MUST be a homeowners/condo owners association and bylaws. What do they say?? Perhaps you should have a lawyer review them.
