Iam a first time homeowner. El Paso has been hit hard with heavy rains for the past few weeks. Now I have leaks, one in the living room and one in the kitchen. There is an all work guaranteed/ 30yr material & 5yr labor warranty from when the previous owner had the house reroofed. I had a plumber inspect my pipes for leaks; due to the leak in the kitchen. Thankfully, my pipes are fine but, now I have a hole in my kitchen ceiling that needs to be repaired. However, the plumber informed me that I have a hole in my roof and that is what’s causing my nightmare. My a/c unit is on top of my roof and apparently the roofers failed to seal a portion of my roof,leaving a hole. I’m in dire need of help! Even though it is the same roof under the warranty,the roofing company said that I am not covered. What should I do? I just purchased the house about two months ago. It was inspected prior to the sale,apparently,they missed the hole in the roof. Any help would be greatly appreciated!Thank You!

I relied heavily on the home inspection to make decision on buying my 20 year old home. Results of the home inspection reported the house was in fair condition with no major damages. So, I bought the house. Just received a letter from my homeowner insurance company advising me that the roof (asphalt shingles) is in poor condition and not acceptable to be insured. The estimated repair of the roof is $ 6300. Can I sue the home inspection company to pay for some, if not all of the roof repair cost? Need advice please!

In many states, yes. Accredited home inspectors have a bond to cover this sort of thing. Now I will ask, how did the homeowners insurance company know about the roof if it wasn’t on the inspection? If they hired their own inspector why didn’t you get a copy of the report? If the sale hasn’t closed yet you can attach an addendum asking the sellers to pay for a new roof(if you have a Realtor they will know how to do this-if this is a FSBO then it is Buyer-Beware and you will probably lose your downpayment if you can’t close the deal(by fixing the roof)

BTW, find out who installed the roof. 20 years is nothing for a roof and it may still be under warrantee. You can find the roofer through the state, county or city building inspections. It is common to see 30-40 and even 50 year warrantees on a new roof.

Is there a special program for people like me – government or otherwise? My bank will not make me a home equity loan because they say my income-to-debt ratio will be too high. The “energy efficiency” program offered to low income people with older homes has a 5-8 year wait in my part of Texas. Hurricane Rita affected my roof – but not enough for my home-owner’s insurance to cover. State Farm said my roof was already over 15 years old and probably needed to be replaced anyway. They also said that the damage was not severe enough -just multiple leaks but no shingles torn off. I need a NEW ROOF most of all, especially before there’s anymore damage inside my home. Does anyone know where I can turn for a loan or a grant? Thank you, Terri

Are you a senior citizen (62)? If so, you can get a Reverse Mortgage, where you borrow against the equity in your home, and don’t have to worry about a minimum income to make payments every month. It is paid back when you move.

i would think if you had damage to your roof that would be covered by insurance you would have already contacted your insurance company. the contractor can look at the roof, assess the damage and give an estimate. filing a claim is your responsibiity (if it’s your house). in most cases, repairs from general wear and tear are not covered by homeowners insurance. contact your insurance company yourself to find out if the repairs will be covered before committing to anything with a contractor.

Its helpful and just nice to have a good boyfriend or husband. Its a plus when he knows about general repair stuff and is there to help you out. But for the ladies, like me, that dont have that whats the best alternative.

I thought about the always new way. New car, new house, new appliances, just everything new and nothing used. That is just a little no alot expensive for me. With new things there could be less headache and questions and warranties.

Or I can have a Mr. Fix It, that could get expensive too. He may not be able to fix it all anyways. Mechanics and handmen get so pricey. I know they trying to earn a living but oh my goodness.

So whats your advise to us ladies?

my sister landlord is completely repairing and renovaiting the Electic wiring inthe bilding .
breaking walls inside the apartments holes open for days dust , devree, lead, and some asbestos everywhere (it its a very old building) her children can not breath (she has 3) is hot and they can not use the AC. or Kitchen. I let her live in my apartment for 4 days but when she cameback home the repairs are still on &even rats were coming out . she wants to go to a hotel because of the living conditions until they finish the repairs . and also wants a inspector to check the bilding because it its dangerous for other families with babies and children living there.

Please friends from Yahoo can you tell me if it is legal for the lanlord to make mayor repairs while the tenats are still living there.if people go to a hotel who paid for it. I call 311 they just said make a complaint and wait. she leaves in 11 54 ward ave , bronx NY . Can anyone help thank you

It is very dangerous to be living in those conditions! If major electrical work is being done, you must move out. And asbestos can cause lung cancer, even if a little is breathed in. Not only that, but once in your lungs, there is no way to get it out! Please don’t continue to live there. She needs to contact a lawyer, the city should have a public assistance lawyer if you can not afford one on your own, or call one and ask, sometimes they will take cases pro bono (without fees). Please talk to a lawyer, and get out of that place! Go to your local newspaper/television station and see if you can get it on the news! Get out of that place, and do something! Your landlord is Wrong to let people live under those conditions. You can withhold rent too! Don’t pay for that. Put the money in an account to have once the repairs are finished. Have all that rent available, but do not give it to your landlord. Then when the repairs are finished, you should be able to deduct what you had to pay for other living arrangements during that time. If he threatens to take you to court, let him. Keep records of everything, bills, receipts of housing expenses during that time, take pictures of the place that is being worked on (please use a mask if you go in there though!). and be ready to fight for your rights! We live in Georgia. My friend used her boyfriend as and her relator and he was fairly new in the business. She found a home that she liked and they put a contract on it. Her relator did not tell her to get a home inspection and this was her first home so she didn’t know. She closed on the home and has been living in it for about 3 months. She started seeing problems with things and had a guy come out to look at it. He told her there were several major problmes and he wrote up an estimate for about 10K. The home has problems such as leaking from the roof, the floor boards need replacing, there is mold in the house and the furnace needs replacing. The seller didn’t even provide a disclosure to her. Being that she bought the home basically as is, is there anything that she can sue the seller for? Who should she call to get this resolved?

Her only recourse would be to sue her boyfriend/realtor and his broker.

The realtor was incompetent. That’s sufficient reason to complain to the state licensing agency.

The boyfriend’s broker is ultimately responsible for the actions of his agents. The broker probably has errors and omissions insurance to cover these things.

And her relationship with the BF is probably going to end quickly and badly. But it needs to be done anyway.
