Located at the end of a Cul-de-Sac. Open house every, weekend (only lookers) –they are only wasting our time. We are facing foreclosure…
What we plan to do is FSBO, and we need your help where do we start? any recommendations?
We have a web site for the house, and plan to place ads in the local newspaper, and pay a commission to the buyer’s Realtor. what else should we do?

Yes we have a signed contract, but realtor agreed that we can get out.

Probably not. It is probably the amount of money that the loan is in arrears. Then you would have to finance the actual amount left on the loan. Now it could be a property tax forclosure inwhich case, the property could be owned outright by the owner but they owe 29,000 in taxes and you can buy the property simply by paying the owed taxes. It is something worth checking out.

I rented a house that has 2 persons on the warranty deed. One of the owners rented the house to us and was the only person to sign the lease but had the 2nd owners name in the 1st part of the lease. The second owner did not sign the lease. Is this still a legal binding agreement if the second owner did not sign the lease to us??

Yes in Many partnerships only one signature is needed. This makes the process much easier. How the two owners conduct their business is not important to you. You signed the lease you live with it

Our family owns 3 homes. The bank foreclosed on the house directly next door to us. We have been interested in this house even before it went into foreclosure because of things- one, because our home and this one where built together in 1903 in the same victorian style And two, because we would love it if we could sell one of our homes or two of the three we own in order to buy this one, one of which my brother and his family live in. We’d love it if we could get this house so that they can be closer to us.

Every bank is different. I would just talk to them. Let them come out and inspect if they are interested. If they are interested in trading and one is worth more than the other, there will probably be an additional amount that one of you will have to pay to the other.
If they will not do that, then I would suggest finding out how much the foreclosure amount is, sell the one house that your brother is living in and purchase the one next door. Just take the money that you get from one and invest in the other. Good luck and I hope this works out for you!

This house was previously listed by two other realtors as a two family. The owners were refered to me by my aunt (they worked together) and they also informed me that the house was a 2 family. They currently pay taxes as a two family. They were reassest in the 70′s but when I go get the CO at City Hall they tell me that the house is a one family. I am supposed to close on Friday. So my question is what can I do? Would the lawyers have seen this when running the title search or on the deed? I’m licenced in New Jersey.
I believe since they have had use on this property has a 2 Family and have paid taxes as a 2 family for the past 40 years, before a CO was required , or a variance that they could fight this with the town and have them grant them a grandfather clause. What do you guys think?

I’d say they are OWED big money in back taxes on a two-family dwelling,when in fact it is a single family dwelling. You know the information and CO proves you know it. Don’t get burned, divulge the information to the buyers, they may actually appreciate it as it would lower the taxes for them!

Sir, it is on Yahoo search and it is the first page that shows up. Check it out! In case it does stop showing up then you have an option to pay to advertise, as I think you just did here for free.
Add: Unfortunately there is not much you can do. I understand it can hurt your business but it’s Yahoo website and it’s upon them how they will sort the search. You can contact them about advertising here though https://public.yahoo.com/leads-cgi/iso_lead_form.pl

I have found a house that has gone through the foreclosure process and is now bank owned or REO. Called the bank, which said it is an investment property. Got the contact information and was told the house is going to HUD. The house is not listed on HUD.gov. So, how long will it take for the house to be listed on HUD.gov?

I’ve seen some HUD properties languish for over six months before all the necessary paperwork is completed for the house to be listed. Don’t expect that it will only take a week or two. It all depends on what issues need to be clarified before the house is approved for sale.
