Hello, I have a request for rent to a real estate broker (in Cairns, Queensland, Australia) But after I realized that since the place is rebuilt, they are for a qualifying period of residence certificate, which could take two weeks or more. Now that I under time pressure to stay out of the hotel I I would be a different place, is ready to go, now am found, I may withdraw my application for this house at this time? all fees will be incurred at all? aviserSalut Please, Thanks, but it is not a single contact point that I have a rental application form signed, because in fact, it’s a closed community and they ask me to specify which floor and how many beds are my preferences, with documents but I have heard nothing from them if my application is approved or not, it’s just that I I must.

We rented a home in Las Vegas, Nv. recently through a property management company and upon doing our walkthrough after moving in (which we found odd they’d ask us to do after we moved in but assured us was completely normal), we relaized a serious issue with the property. The upsatairs bathroom toilet was sitting side ways and we noticed that it was due to the floor having previous water damage and sinking in, also noticed a large amount of mold around the floor and that the floor boards are loose due to half of the bathroom sinking in. Not only is the mold a health issue, but anyone of us showering or using the restroom in there could be seriously injured. Long story short, we reported the issue to the property manager and also made him aware of the fact that I have a chronic health condition, in which my immune system is compromised and that I could not be in a home if it has mold, he gave us the run around for an entire day, within which he made an untactful joke about how he did not care about my health. He then told us that us that he would call us by the end of the day and let us know when someone could be out. Never heard from him and when I called back I was told he’d left for the day. I then asked to speak with his boss, who proceeded to not listen to my complaint, ask me to hold for a moment, (and without telling me) forward my call to thier general contractor, whom had no idea who I was or why I was calling and said this was the first he had even heard of the problem. We now feel a major lack of trust for this company. We paid a lot of money to move in hear because we thought this was reputable company and their lack of communication with us, just make us feel as they don’t even care. We would like to know what our legal rights are in Nevada for breaking this lease if any at all. And who can we contact regarding making sure this issue is taken care of promptly and properly. We signed the lease 3 days ago. Please Help ASAP!

You cannot break your lease. You call the local Building code enforcement officer have him/her come out and do an inspection. They will issue violations and either have you vacate or make repairs mandatory. Suggest you put your complaints in writing, sent certified mail and inform management if problems are not corrected immediately you will be calling the town for an inspection.

We were purchasing a mobile home from a private individual and our contract started in 2/07. We had no problems until June of 2009. I lost my job and was late on a couple of payments. The contract was for four years. Toward the end of June she presented us with an eviction notice and a demand for payments totaling over $ 2500. She claimed that it was for missed payments and late fees. We were stressed with job loss and health isssues with our three year old so we scraped up the cash and paid her. This got her off our backs until January 21, 2010 when she again showed up on the doorstep with yet another demand for payment with “Misc. late fees added”. I went back through my bank statements and found over 10 payments she had stated we missed and had charged us for on her notices. In addition she was charging 115$ per month late fees and the contract explicitly states the late fees to be 10% of the payment (our monthly amount was 284 so late fees should have been $ 28.40.) By this time I had secured a pro bono attorney and forwarded all information to him. He said not to worry about it and he will call us when she acts up again. Well that was in february and by aug. I called his law office to touch base and spoke with his para legal. She stated that she believed the lawyer had managed to reach an agreement with this crazy woman. Well, he apparently dropped the ball because on Oct. 15 this year she showed up on my door with a demand for $ 5500 and a 3 day notice. I told her it was illegal and ordered her off the property. the following week she paid someone to serve us with a three day notice that she had filed through the court system. I filed for a continuance on the grounds that the notice was a lease purchase and doesn’t meet Idaho statute for an expedited eviction and explained in the continuance that I needed time to get original bank records proving my payments were made. In addition she did wait the full three days needed to file for the eviction so it was illegal on that point as well. The judge agreed with me and set the hearing out until Nov. 16th. I attended the hearing and the judge explained to her the same thing. It is a lease purchase so it does not qualify for and expedited eviction. Now, heres where things get really bad. We had been out of the state from Oct. 27 until the morning of Nov. 16, the day of the hearing. We went by the property to see if she had been there and sure enough. That bat shit crazy lady changed all of the locks and had an ad in the window which she posted on craigslist on November 11th listing the house for sale! I called the sherrif’s department immediately and they took the report but basically said it is a civil matter. Following the hearing I called crazy lady and asked for the keys to which she basically said I could “F” myself and warning me that if we attempted to get into the property she would have us arrested. So now we are living in our 18 wheeler and have to take our three year old with us on the road. I sent her another letter last week demanding the keys and she sent me an email back with her supposed lawyers number. The neighbors all told me that she has run this scam MULTIPLE times but we are the first to fight her. How do I proceed from here. We are in Boise, Idaho. Any feedback would be appreciated. Thanks.
She finally did file for an amended complaint on dec. 2 but when I called to see if a hearing date had been set, the court told me that there had not been one. She also used pictures she had taken while in our house in her craigslist ad. These pics showed all of our personal belongings and cars in the driveway with visible license plates!

Tell you lawyer to file a notice of lien on the place and go in and change the locks notify the police adn the Attorney Neural of your state. You still own the premises and she does not .Fid out who changed the locks and notify them that it is your property.She has not even legally defaulted on your contract she took your house,
CONTEMPT OF COURT Have your lawyer go back to the judge and see if this is possible
Have a friend call about the renta; and if legal record the conversations

About 10 months ago, I lived in Dallas, TX. As a Dallas resident, I lived in a house with 2 other roommates. After fulfilling more than my one-year committment to the lease, I found a job that would require me to transfer to Houston, TX.

After 13 months of living in the house, I gave my roommates two months notice that I would be moving out (and even paid bills and rent for an entire month that I did not live there).

I have called the property management company several times. They claim to be “working on the issue,” but there has been no action taken to relieve me of this contract.

The original roomates still live in the house, but I would like to be released from the contract so that I am not held liable for any non-paid rent/late fees/damage to the property.

The short answer – the owner/manager needs to write you out of the lease.

There isn’t any other way to get out of a lease.

I terminated my lease on a home I was renting by giving verbal notification over 60 days prior to my move out. I encouraged her at this point to start showing the home to find a new renter. My landlord never attempted to rent out the home and decided instead to sell it and had a for sale by owner sign in the front yard 2 weeks prior to me moving out. One month later she had it listed with a real estate agent. She is demanding me to honor the lease term even though she has made no attempt to rent it out. She also has kept my security deposit without any written explanation of any repairs necessary. Then to top it off she contacted my fiancee and told her about the entire situation which is confidential information and goes against the the Fair Debt Collection Practices Act.

How would you suggest I handle this situation?

Note there was no early termination clause in the lease and I live in Atlanta, Georgia.

You and your landlord have a legal binding contract for you to rent this property until the termination date stated in the lease. The landlord has every right to sell the property if she so chooses. Generally speaking, when a tenant attempts to terminate a lease before expiry, the landlord will attempt to procure a new acceptable tenant for the property. However, the tenant remains responsible for all costs which would have normally been tenant responsibility had tenant remained. Such costs include the rent value, and any utilities for which the tenant is responsible.

Additionally, because you are seeking early termination of the lease, the landlord may charge you the costs of procuring a new tenant, including advertising and fees to show the property to prospective tenants.

Security deposit handling is covered under Georgia Law, and it appears that your landlord is within her legal rights to retain your security deposit for unpaid rents and other charges, if there are any. Additionally, since your lease is still in effect, your landlord is under no obligation to return any security deposit due to you until the expiry of the lease.

If the landlord violation of confidentiality required under Fair Debt Collection Practices is important enough for you to spend money on, do contact an attorney relative to possibly filing a charge. Bear in mind that any enforcement of the act is the purview of the Federal Trade Commission. Sad to say, I think your complaint might go to the bottom of a very long list of issues FTC must handle.

Don’t do lease to own. Just lease until you can qualify for a loan. Prices will be dropping anyhow in Texas in the next year.

I recently moved to the San Antonio area for a new job which seemed to be a great new opportunity in my life. Moved here… got a nice rental house and signed a year lease thinking nothing of it. However, nearly three months have passed and the job turned out to be a sham… nothing like they had posted (but that is for another time). I’ve considered moving back to my home state but I have some questions about the lease. Where I come from (Kansas) lease agreements have an early-termination clause that usually allows a tenant to remove all responsibility before the lease ends typically by paying some kind of fee and a penalty (such as 3x the monthly rent). I looked over the rental agreement with this property and it has an early-termination piece but doesn’t really say a whole lot.

The lease is a Texas Association of Realtor Residential Lease and the Early-Termination Clause states that the lease can be terminated under Military leave, Family Violence, or by the landlord and/or tenant securing a new tenant to lease the property.

I’ve read in other places that Texas law states that once a notice to vacate (60 day notice typically) is given that the tenant is no longer responsible for any unpaid rent…

My question is am I locked into this for the entire term or are there other ways out of this lease? I’ve tried contacting the property management company but they seem to never return my calls (seems to be a common problem with them).

This past July 1st, I told my landlord that I had to break my lease (I was being transferred to another city). He said that he would try to work w/ me to try and work something out. Since then, he transferred the property and the lease to a local property management company. They have no desire to let me out of my lease and have done little to help to try and lease the property. Is there any recourse w/ this management firm?

I rented a house that has 2 persons on the warranty deed. One of the owners rented the house to us and was the only person to sign the lease but had the 2nd owners name in the 1st part of the lease. The second owner did not sign the lease. Is this still a legal binding agreement if the second owner did not sign the lease to us??

Yes in Many partnerships only one signature is needed. This makes the process much easier. How the two owners conduct their business is not important to you. You signed the lease you live with it
