6 month ago…my apartments paid to move some residents. This was forced by my documentation of Stachybotrys and Pennicillium mold at 90X outside air. Given, that no one seems to want to “go there” on the mold issue (do you?), I am left with an unresolved situation which arose from the actual move itself.

The manager, by default, and without notification to me of anykind, did not insure my things for value. She instead opted for the standard (default) coverage 60 cents per lb. My $ 2200 claim with the movers, went to mediation and was setteled for $ 400. I have unreimbursed losses and expenses for which I believe I have the right to (at the very least) be made whole. I have written the corporate legal department…stone wall. Deny, deny, deny, stall, stall, stall. When I suggested that I would withhold rent they sugggested they would sue me!

It might not get you anywhere, but get the media involved. Call your local TV station or the one in the biggest city near you if you’re in a small town. They probably have an “on your side” team. All our local stations here have them. I see this kind of stuff on the news all the time. It usually works out in the tenants favor due to fear of bad publicity. I’m not saying it will work but maybe it’ll rattle some chains.

Before you do that – find out the basis of the denial. Have them send you the reason fr denial in writing along with a copy of your policy. If the denial is legit – it’s a waste of time to sue because you’d lose.

If you still want to file a law suit -you have 2 options.

1. go to your local magistrate court and file there. That’s “small claims” court. Peoples Court kind of thing. You don’t need an attorney and can do it yourself.

2. if you are seeking more than the max amount allowed by small claims court you will need to hire an attorney. Take the policy and the letter from the insurance company with you. If you find that no attorney will take your case – that’s a good sign you don’t have a case.

Just bought a house in los angeles area. The home inspector did not detect a major leak in the plumbing nor did he see a visiable crack in the footing of the housing. The crack was visable from outside and if he had seen it we could have known that the crack extends all the way inside the house underneath the carpet. The seller will not take any resposibility for any repairs, says did not know about cracks and if we had it in the inspection report, prior to close of escrow, then they would have dealt with it or fixed it. The cost for repair of the cracks outside and inside of house is $ 3000. I dont know how much the plumbing is going to be for the leak. So now I want to go after the inspection company how should I go about it?

I do not know about California, but what home inspectors generally do is make clients sign a waiver dissolving them of any responsibility of mistakes.
