It is supposed to be a part of the sale of the property… old landlord gives it to the new landlord.

We rented a home in Cedar Park Tx. We had to sign a lease and the home looked fine at first. Mold appeared everywhere. In the lease it was stated that we were responsible for mold. There wasn’t any when we first looked at the house but weren’t able to move in for a month due to the landlord working on it. There was mold everywhere. Under every sink, the showers, etc. I called him and he said oh well. I got very sick, had headaches and thought I had the flu all of the time. I got a liver disease and we finally were able to buy a new home. I have not been sick since. He has re rented this property. He is a slum lord. My question is how do you stop these people? Who do you call?

I returned keys a week early (on 25th, though I paid rent through march 31st, 2010), had a walk through.
I was told that they would charge me for half of the carpet replacement. Later on monday 29th my wife found out that they already put hardwood floors over the weekend. Can they charge me for such an upgrade? Aren’t they supposed to show me a receipt for carpet, so that they can charge me half of it? I stayed in this apartment for 4 years 3+ months.
I told the management to charge me for cleaning, and did not agree on the carpet issue but told them to send me an estimate/quote for the cost.
What should I do?

To Ryan: Answer 3 is the one I want to find out more about, preferably relevant law. Yes there’s nothing about charging half of the carpet, that was a verbal comment from my landlords, quite greedy husband and wife, and I found out that they lie quite often.

1) There is nothing in the law that they can only charge you half. In fact, anything above wear and tear is 100% your responsibility to pay.
2) Was there a “wear and tear” clause in your lease? For most places, if you live there for more than 2 years….they cannot charge you for carpet wear.
3) They cannot charge you for carpet replacement, if they did not replace the carpet. You are not expected to help pay for THEIR remodeling costs…which is what they are trying to pawn off on you.

Remind him that he needs to give you 24 hours notice and ask him to make sure that the MLS mentions that fact clearly.

There’s a rumor that my landlord will be evicting everyone from our building – 9 apartments in all – in order to turn it into office space. Without a lease, how much notice do they have to give the tenants? Located in Upstate NY, not NYC.
I asked her straight-up if they were going to be going forward with the plan but she just denied it, meanwhile there were contracters in each apartment inspecting for asbestos and taking measurements so…

With no lease, the conversation is over.
You have no contract with the landlord. She can terminate the relationship at the end of any paid month.
Going forward, get it in writing.

Hello,
I live in a nice neighborhood in Atlanta, GA with an HOA currently controlled by a property management company– controlled by the developer as the still has several phases to complete.
We’ve had several burglaries and found out they were being committed by a tenant of one of the homes being rented out. This burglar was caught and jailed for 2 weeks. There were no break-ins during that time. He has since been released and was seen attmepting another break-in but was not caught this time around.
My question is, since we know this tenant is a criminal, what avenues does the community have to get him evicted? Can we hold the landlord liable?

Many times rental or lease agreements will have a clause that states that committing a crime is a violation of the lease agreement. I used one like this once. If the leases used contain such a clause, then this may be grounds for eviction. You will have to check with the landlord, but otherwise the landlord did not commit a crime and so is not liable for someone else who did, unless perhapes it can be proved the landlord knew about this crimes and was a conspirator.

He told us to try to get our own coverage when we moved in 2 months ago ( we tried, but unless you are the homeowner- you cant change the policy) and he will not fax over documentation to Allstate. They quoted us 1200.00 a year!!

there is NO way that your homeowners insurance should be 625 a month!!!!!!! i pay less than $ 400 for the year!! i think your landlord is jipping you.. what kind of rent to own contract do you guys have?? i bet you guys are paying all this rent, and he will probably never give you the property.. you need to find out what is going on!!!! seeing as how he won’t even e-mail or call you back about something so little, imagine whne you pay off the house and want it signed to you.. i anticipate trouble for you!!!!

I am currently renting the upstairs section of a 2 family home. I have asked that my landlord provide me with proof that the house has been inspected. However, he has not provided me with anything. I really don’t think the house has gone through inspection because we moved in right after he purchased the home and I don’t remember anyone coming to inspect the home. It was a foreclosed home so I doubt if he got the inspection done before we moved in. Is it illegal for him to rent this house to tenants without a professional inspection being done? If there is a law against this please tell me where I can find that information. I am located in the state of MI. Thanks!!!
