Question : Real Estate issue – - – What would you do?
Here in Tampa, Florida, a lot of houses are sitting on the market for awhile and 90% of houses for sale are short sales or bank owned properties.

There is a townhouse that I really want that is banked owned listed for 89,900. It JUST came on the market on Friday, so 2 days ago.

The EXACT same model townhouse with the same features and everything just sold for $ 105,000.

We went today to look at the townhouse and it was move in ready, didnt need any work except 2 of the rooms needed to be painted another color because they were aweful colors.

Anyway, I called the listing agent today and they said there were already 2 offers in on the property and that on Tuesday he would be sumitting all the offers he gets up until Tuesday morning.

My question is…What should I offer?

Now days a lot of people think they can low ball bank owned properties, but this one is priced really good.

Any tips on how I can make sure they pick my offer?
Yes I am already pre-approved for $ 105,000 and have a letter from Century 21 mortgage.
I asked what should I do?

and I dont have 95K cash, I said I was approved for $ 105,000, so saying you would offer 95K cash doesnt help me.

in this market…skip the real estate agent…they are just looking for the commission….go directly to the bank and have ‘frank discussions’ with them about what YOU want to offer and WHAT YOU can afford.

This is in the state of MA.

My friend called me last year June that she needed a place to stay for a while until she gets on her feet. I stupidly agreed to let her stay with me for a while, She moved in late july. She told me that she’s only bringing a luggage with her nothing else but to my greatest surprise she brought her two couches, 60″ inch TV, her boyfriend and her dog along with her, I couldn’t say no to her because i thought she was my friend and my house was big enough for her stuff. She kept everything for use in my living room. I left for the weekend and came back on sunday with some of my friends and i noticed the house was not tidy and smelling of dog **** and urine, I was so mad i called her on the phone to tell her that the house really stinks she got offended and told me that I needed to buy cleaning agent so she could clean after her dog I was so mad at her for saying that so she told me she isn’t coming back and i didn’t beg her to stay either. well i didn’t hear from her for over two months and she wasn’t talking to me but in the beginning of setember her boyfriend contacted me that he wanted to pick up his school stuff we made up a time and he came to pick it up (her and her boyfriend weren’t in good terms) anyways my house was broken into in the middle of october and they took her Tv and i called her after I called the police to file a report to let her know about the theft in my house she told me that i should claim it under my insurance and i told her my insurance only covers my own property not hers then she got really defensive and she started saying that i never let her come pick up her stuff and i always gave excuses whenever she wanted to come pick up her stuff therefore she was going to sue me if I don’t pay the full price well it took her another two months to come pick up her couches, she finally came at the end of december to pick up her couches she left then later sent me a text message saying that her couches were damaged with red markers on it i told her that i didn’t see any damage on the couch and she failed to show me before she took it out. Anyways now i just got a small claims court order filed by her saying that i held her property for over two months and refused to release it after numerous attempt to get it out, and that she wanted me to pay the full price of her TV and pay for her supposed damaged couch. she lied on the small claims statement. I never had any comunication with her before her Tv was stolen and now she knows I am not paying a dime for it she coming up with this ridiculous stories. What can i do here? Am I legally responsible for her stolen Tv and since i never threw her stuff away because she had no where else to store them.

I felt sorry for her and said i would call my renters insurance to claim the theft but it was denied because the property wasn’t mine and they won’t cover it. I then offered to help her pay for the TV thats is provide half of payment and she provide the other half, she refused and told me i should pay the full price of the Tv which i certainly can’t do. I also have emails and text messages from her confirming all this.

Keep all emails and texts. She will have to show that she tried to contact you. If she doesn’t have anything to show she contacted you, ask her to provide it. This could be phone records (I would bring yours and show where you didn’t receive calls from her), emails, etc.

Okay my husband and I bought a brand new home 8 months ago. Before we purchased we had a walk thru with an inspector and we noted some water stains on a window seat. We turned in our punch list to the builder and he in turn said that he fixed all things on it. He said that they had a roofer go up and make sure there was no leak and that someone had prob. left a window open some. So since he told us that we went to our closing thinking everthing was fine. Well now that it is spring the rain has come and it poured into the window and all over the window seat. Now there is water damage all over and the builder said that there would be mold in there when they are pulling things out. My question is this can they be sued for deceptive trades since they knew of and didnt fix the leaky roof? We live in Texas and we have to dislose the fact that we had a roof leak and water damage even if it is fixed which in turn will bring down the value of the home. Any help would be great. Thanks

Legal liability issue on pest control contract? Grey area?

Question : Legal liability issue on pest control contract? Grey area?
I am taking care of a home while young friend is away on vaca for 3 more weeks.Severe insect invasion prompted homeowner to call a pest control company to make inspection and give advice. The technician called the homeowner in my presence and she decided to use the services of this company. The technician called the office and said I would have to sign the work order/contract with my name “for” the homeowner’s name. This was verbally approved by homeonwer and she called the company to pay by credit card the first installment. My husband disagreed with my action and wondered if I could be held liable for the yearly contract even though I signed my name for the homeowner. (The homeowner’s husband is out of country serving US and could not be contacted–I was just trying to HELP!) Any one know the law in the case? The owner would never put me in a bad position but my husband kept saying I should NEVER do this in the future and was disappointed in my actions. Waaaah!

How did you sign? Did you sign your name and put “as agent for ________” or something to that affect? That would have been the correct way.

If you just signed your name, technically you could be held personally responsible. But I don’t think you’ll really run into problems.

Ok now this story really makes me sound bad but please try and focus on answering my questions more than saying how much of a bad guy I am. I was arrested for battery to my grandmother (I never hit her please read on to find out more) Ok well they arrested me and ended up letting me go later that night. I got back home thinking I must of blacked out and hit her because I was positive I didnt touch her. Well I ended up getting more court date, asked for a public defender, and then we got our appointment with the PD. I get to the public defenders office and they offer me a program called NAB (Neighborhood Acountability Board) I thought this sounded better than probation since they said if I didnt take this chances are I would get probation. She told me that if I take this and fail the program I would be done for because upon taking this program I had to admit that I did the charges. I really thought I had no fighting chance against the legal system and went ahead and took it (BAD CHOICE) When I entered the program I was told what I had to do bla bla. One of the things is work on schoolwork for 2 hours a day (I do florida virtual school) Well I didnt exactly do that D= This is where the story starts to sound shitty on my part. Ok so I was about halfway through the program when my grandma started bitching at me for not doing the program the right way. I got pissed off and told her its BS I am even in the program because I know I didnt hit her. She got a smirk and said thats right you werent arrested for battery they arrested you for the way you were speaking to me. I know they cant arrest me for swearing at her (Not even for disorderly conduct because they werent there) and so I was really pissed about not even being arrested for what I was told. Now I was mad because I took the program admitting that I had assaulted her. Well now I thought I would just get through the program and then just forget about it. Well…. I had 3 weeks left of the program. I had stopped smoking pot during the program just incase they drug tested me. Well …. I was stupid enugh to go and start smoking again just a few weeks before the end of the program ARGH! well I wasnt worried about it until now. I have tomorrow and the next day I go to the program to get out of it. IDK what to do if they go ahead and drug test me. I was wondering can they legally just pop a DT without my moms consent? (I am a minor if you havent figured that out) Also I am worried they are gonna ifnd out I havent worked 2 hours a day so I have prepared what I am going to say for that (I hate to lie to em but I am better off lieing because if I dont ill prolly be dropped anyway D=) Worth a try. Anyyywayyyy yeah about the drug test can they just do it without my moms consent?

Depends on the terms of the agreement that you made with them. Did they tell you that it’s possible you’d be drug tested? If not they probably won’t. If they did say they would drug test you then don’t be suprised if they do.

I felt this after I moved in my new construction home at several places, but just didn’t think much. Now I realize that the wood is not firmly attached to the subfloor/base. I can easily hear the sound difference when I tap the floor. Is this called sapping, buckling, or …? Should this be fixed? How difficult is the repair? The builder warranty should be there for the fix?

start with a lic. home inspector…..be sure u tell him ahead of time that u want him to test ur house for moisture so he can bring a meter that will measure this in ur walls and ur ceilings and joist under ur house if on a crawl space…..he should be able to tell u how to fix it or led u to someone that handles the said problem…

It says that it has 60 amp service and 100 amp main. I’m confused. What all would it take to correct this problem and about how much would it cost? Thanks!
I have called electricians and they all charge for an estimate! I couldlnt believe it- I was hoping for a quick ballpark answer over the phone. Any ideas on cost would be greatly appreciated!

as far as the cost goes call an electrical contractor and get an estimate. the house currently has the ability to protect 60 amps of current, pretty small for some of todays modern equipment. the inspector would like to see a 100 amp entrance put in so there is no problem down the road as far as tripping breakers or blowing fuses. (i would never put in anything less than 200A myself)
