I am currently firing my property manager. I sent a certified letter and verbally notified him. He was not pleasant after hearing that the contract would be terminated. I am wondering how long he has legally to return my trust account belongings?

My question is not about during the offering, or negotiation stage of buying a home for CASH, it’s about what happens at the actual clsoing.

When you buy a home for CASH and you go to the attorney’s office to close, what documents would you have to sign? Do you sign the documents before or after you deposit the CASH into the attorney’s trust account?

Also, what protections do i have if I deposited a CASH wire transfer into an attorney’s TRUST account. Does the fact it is a TRUST account give me greater protections against fraud if say they attorney went bankrupt?

You should have the following properly documented:

1) Seller’s agreement to sell the said home for $ XXX amount (ensure the address is correctly indicated in the agreement).
2) Confirmation letter from the Attorney that $ XXX being the agreed purchased price has been handed to him to be placed in a Trust Fund and be released to the Seller only upon receipt of your instructions to do so; you will give instructions only after you’ve inspected the house and after handover.
3) Agreement to indicate date when the sale documentation would be completed.
4) Date of inspection of the house prior to handover.
5) Expected date of transfer of ownership from Seller to Buyer.

You need to exercise caution when dealing with cash transaction. You do get protection for money placed in Trust Fund. However, you need to ensure that the account number given to you is a Trust Fund account and not the attorney’s personal account.

I recently applied for a mortgage loan but when the consultant gave me back my w2 forms two of them were missing, if i become a victim of id theft, what legal actions can I take against mortgage officer? Perhaps There’s a book that might show me steps to take?

Losing your documents was careless (they are probably in someone elses file) but hardly criminal. If someone from a mortgage company wanted to steal your identity, they already know your Social Security number, birth date, bank account numbers, etc. As a mortgage broker, we had to be licensed, hold a bond, prove a certain net worth, and run complete background checks on our employees, as they did have access to such information. I never knew of an ID theft from a mortgage company employee – its possible, but not likely.

That is not normal, but why are you worried? Are you sure that it is an FHA loan? What is the interest rate, and how much equity do you have in the home?

I got the court documents over the weekend – I am in New Jersey – and I have a question.
I am making up my name here. The defendants list says:
“Mary Smith; Mr. Mary Smith Husband of Mary Smith; and XYZ Credit Union”.
XYZ Credit union is the bank that holds a home equity loan against the house that is being foreclosed.
I purchased the house 9 years ago on my own. I lived in it until last year when I lost my job and moved out of state to get a job although it was at a huge pay cut – - after moving out I got married, so my husband never lived in the house or had anything to do with it.

I don’t understand why the 2nd mortgage bank or “Mr. Mary Smith” are named as defendants along with me on the court paperwork.

I don’t want to object to the foreclosure, but I am going to have a HUGE problem with my now-husband being dragged into this mess.
I depleted my 401k account trying to keep current on the house until I could find a buyer – which never happened. I have no savings, I make $ 24k per year less than I did when I bought the house. I live paycheck to paycheck now.
I thought that just letting the house go to foreclosure would let me get a fresh start.
I will be calling lawyers today, but I wanted to ask others for some help or advice.

The house is not in a community property state and I do not currently live in a community property state.

If you live in a community property state your new spouse became half owner of the home and will be named on the paperwork. The credit union is named because they have a second mortgage on the house and it is subordinate to the first. They are going to lose their equity share on the property by this foreclosure.

The credit union will eventually sue you for the amount it loses.

I have been getting help with that quesiton at loansafe.org
The site has information on what you need to do as well as contacts to different banks/mortgage companies. They are with you when ever you have a question and there are success stories there and people are willing to help and answer questions and point you in the right direction.
Hope this helps I am in the process of trying to do a loan modification as we speak. Been at it a week now but sometimes it takes longer. They say you have to be patient.
But get your hardship letter ready (sample are on that site)
Financial budget. With 150 to 200 left. Pay stubs, bank statements etc. Good luck
