Question : Do senior housing communities discriminate?
Many senior communities restrict ownership or renting to people who are 62 and older. The Older Americans Act protects people age 50 and older against discrimination and the Fair Housing Act prohibits discrimination. So what allows these senior communities to prohibit selling/renting to someone younger than 62?

The law, federal and state, allow for senior citizen designated communities to restrict due to age only. Still they can’t discriminate do to race, national origin, religion, sex, marital status, color, and ancestry.
Federal housing law concerning “senior persons” falls under the Federal Fair Housing Act (Title VIII). Also in my state the “Unruh Act” section 12900 which is much stricter than federal law.

Question : Why are builders allowed to discriminate against young people in “senior communities”?
Is there some rational basis for this, or is it just special treatment given to older people because they vote?

Question : To what extent can a municipality discriminate against rental property?
Specifically, can a municipality legally require a more rigorous code inspection for residential rental properties than for owner-occupied residential properties? I need an answer with links to case law or something specific like that.

Yes, it is standard for the requirements to be different. This is because when you live in your own house you are not responsible for anyone elses safety. There are stricter rules on locks, doors, stairs, railings and things like that.
I don’t know were to find any case law on this. I just know the general standards.
