It is supposed to be a part of the sale of the property… old landlord gives it to the new landlord.

We lived in the state of Indiana and were transfered to Florida on short notice. We provided the paperwork to the rental office and left the apartment spotless and in very good condition. We were told that our deposit was coming in the mail…for 5 months. Now we are being told that we are not entitled to our rental deposit at all and will not being getting it. Wtf?

Is there a law of some sort for this kind of thing or are we just screwed out of $ 400?
I have asked for the owner of the complex’s phone number so that this can be explained to me…WHY they’ve been telling us for 5 months that we were entitled to our deposit and are now not and they are refusing to give me the name or phone number of who is in charge. We didn’t rent from some shady landlord. It’s a very large complex. Something just doesn’t seem right.

I would think if you provided them with the orders it’d be given back to you… I’m sorry, I’m not sure.

I was purchasing this bed & breakfast in upstate NY, once my offer was accepted by seller i went in contract to buy with contingency terms ( like inspection, mortgage approval etc) I had given 10% deposit almost 70k to sellers attorney to be held in trust account then i went in to get the property inspection and i found like lots of problems some were black mold, bad saggy roof, crawl space had water almost 1 ft deep and structural problems after seeking advice with my attorney i decided not to buy this property so my attorney sended a notice to seller attorney based on contingency i am not interested in buying this but seller attorney is not willing to give my 10% deposit back , so i am looking for an advice in this can i file a complaint or report to government service so atleast i could get my deposit back , Please advice!!!!!!!
By the way i use the realtor who was also the listing agent , she is saying once the seller’s attorney says the deal is off she will returned some portion of deposit she is holding?

My wife and I signed a contract to purchase a new home in August of 2005. Since then, our finances have suffered because of unexpected medical expenses and a prolonged illness in the family, requiring our assistance. While the new home has been constructed like we dreamed, we have been declined for financing because of our debt ratios and because we could not come up with the down payment because my spouse has been helping her parents extensively and unable to earn a steady income. The construction company has given us two weeks to come up with financing, or forfeit our earnest money, approximately $ 34,000. I’ve worked with several different companies and all have declined our financing. The home was constructed in VA. After re-reviewing my contract, I did not find any financing contingency in there that would refund my deposit if my financing was declined … it appears that the builder has insured that they could keep the deposit under all circumstances. Do I have any remedy?

the home was sold on July 27th at an auction and that is the day we moved out. we returned our keys and sent a letter explaining where to send our deposit on that day. the 21 days has now passed and we did not recieve the deposit or a required deductions list. the landlord did not even give us the required inspection prior to moveout. we are going to take him to small claims and sue, i think we have a very valid bad faith claim as well, to ask for double the deposit. i have been reading about california civil code section 1950.5 which covers this, but i was wondering if anyone has any suggestions, have had similar experiences, or know of any relevant prior cases that i can use in our defense. thanks

You don’t need any other cases. Your basis in fact is solid. Now that being said, good luck trying to collect! Do you really think that if they let their house go to foreclosure that they care if you sue them about a deposit? They probably have a long list of creditors waiting for them to crawl out of the hole they have been hiding in.

The owner did have fire insurance. I live in Pennsylvania and had been living at the property for a year.

My landlord is fictitiously claiming damage to his rental property. There was no damage inspection sheet filled out and signed by the tenants and landlord. Also no photo documentation. Is it just my word versus his or is there ground for me to stand on in court?

I think it all depends on what stipulations are in your lease. There should be a section on security deposit withholding.

Banks will collect interest and principal payments when they issue loans. They loan out deposits to borrowers. When you buy a CD, the bank lends that money to someone at a higher rate of interest that you will make on it. Payment services is another form of revenue for the bank.
