Dealer Services Corporation says car theft is sanctioned by the Uniform Commercial Code. After being convicted of the conversion of Behyar Fariba’s cars by a San Diego jury in May 2008, DSC filed an appeal.
DSC claims that they had no knowledge of Fariba’s consignment agreement at the time DSC gave loans in 2005. However, DSC ran off with over fifty employees of Automotive Finance Corporation, another floor plan lender, who had just finished making loans.
However, Fariba probably didn’t know that both DSC and their cohorts AFC were both unlicensed as lenders in California at that time. AFC did not obtain a California Finance Lenders License until August 7, 2007. DSC just got their California Finance Lenders License on May 27, 2009. AFC made loans in California for more than eight years before obtaining a license, DSC only waited a short four years.
How can a UCC1 be used like this to steal cars that DSC and AFC don’t have the titles to?

Your question left out several key details of the series of transactions. That said, the Court would resolve issues of title under Article 9 (Secured Transactions) of the Uniform Commercial Code as adopted in California. Furthermore, the matter of California licensing
would not have likely played any significant role.
The UCC is designed to establish an open public recording of property interests based upon time of filing priority system.
The fact a legal entity did not legally possess the licensing right to engage in a particular business does not deny claims of title or authority to transfer title.
The UCC-1 is a public filed documents that can be readily found in public records and even the internet. It gives legal notice to one of potential title claim.

My husband’s 2007 Mazda 3 has been knocking. He had to drive it home and then to the dealership on Monday (9/29). The car is still in the shop. We’ve provided all the maintenance receipts as of Friday. Dealership called my husband today saying they needed his OK to open it up and if they see that it wasn’t properly lubricated they will charge him for the whole deal. The car is still under warranty, they have the proof of maintenance. Is this guy just being a jerk? Or have other people experienced something similar? This smells like a lawsuit!
Engine started knocking on Sat 9/27. Dealership is closed on wknds. Delivered to dealership at 9am Monday 9/30.
We only drove it to the dealer. No one is arguing negligence. It’s been properly maintained on schedule. They STILL don’t want to do the work.
btw, it’s $ 8,000 for a new engine.

The first question I would ask, as a mechanic, is how long has it been knocking? If it’s been more than 2 days it’s your responsibility. Any one who has a vehicle should be able to check the oil. By letting it go too long it voids the warranty due to your negligence.

I hope to buy a new car next year. The problem is the brand of car I am interested in does not have a dealer near my home. I live in a rural area. If I am required to go to a location that has a brand name dealer I will be driving about 230 miles just for something simple like an oil change! I would think they would require this in order for my warranty to be honored but thought I would ask and see if anyone knows this answer for sure. Thank you in advance for your help,.

MY wife found a car on the internet. We are in Florida (sucky consumer protection state). The dealer has an as is warranty policy. Before signing anything, my wife asked if there were mechanical problems, she was told there were none. The internet ad does not list any problems with the car. She took it for a test drive with no apparent problems. When she got home, it overheated, We looked and there was no fluid in the radiator. The battery died overnight which we replaced. Now the car refuses to start. The dealership refuses to speak with us. They worked on the car to make it look new, especially the engine. So, it appears there is more wrong with this car than advertised and what they represented. Maybe this is why they have an as is warranty policy. You sell a defective car and you are off the hook. Any advice on this? Do we have any rights under Florida Law?
btw, my wife checked all fluids. Engine was detailed to make it brand new looking. She specifically asked for problems was assured there were none. Checked car on Carmax, said car was not in an accident. She wouldnt have bought car if there were problems

I just came home from my 2007 Mazda regular service and got shocked to see the details on my bill.
The dealer charged me $ 127.00 for replacing Cabin Filter. The break down of this is $ 29.73 for parts and $ 98.00 for labor. I felt very bad about it. Can he charge like that? How much time it takes to replace a filter and what hourly charges he can bill me? Is there no limit on this?
He charged me $ 9.16 for brake fluid and $ 98.00 for service. He charged me $ 35.54 for oil change.
The total bill is $ 276.71 out of which , Labor is $ 206.00 and parts is $ 64.43.
If one can change cabin filter in 15 minutes and charge me $ 98.00 for that, he is charging me $ 392.00 per hour. Is Obama getting this rate?

The two separate charges of $ 98 for labour sounds like he charges $ 98 an hour for labour with a one hour minimum. Weather you can go somewhere else an still keep the warranty totally depends on the wording on the warranty. You’ll have to read it very carefully, but I would expect that it does NOT require you to go to a certain place for routine service. However, just in case, make sure you keep ALL the routine maintain paperwork.
