Question : What can I do if the maintenance people at my apt. stole from me?
I was evicted from my apartment. I paid July rent late, went to my apartment on July 26th, there was no notice on my door. I paid August rent on time, returned on August 26th and I had been evicted and I had no idea. They emptied all my belongings into a storage facility and in the process damaged multiple items and they pretty much took whatever they wanted…. jewelry, phone, bed spread, sheets, blender etc…. I am especially angry because some of the jewelry they stole was given to me by my deceased Grandmother. Can I sue them? The management company was no help of course. I am honestly heartbroken over this situation and want some kind of justice. Any ideas?

If they legally COULD evict you (as in, because of the late payment, you were evicted) verses, if they warned you, and you legally made it null by paying on time, this depends on the reason they evicted you)

If you nullified the reason they were allowed to evict you, you can sue them for everything from theft to harassment. It appears you case is solid, you should be able to sue for at least double the value of what was stolen, and even for the rent money you paid, (since they didn’t apply it for that month)

I personally would sue them to the ground, take every last penny, but you have to have a case stronger than tempered steel to win all of that. Remember to claim emotional damage for the items they stole, and possibly discrimination as to why they didn’t give you notice or proper legal reason.

Hi! In condo apt. was a common pipe leak and my kitchen flooded. Plumber came, tore wall out, fixed leak. Plaster fixed ceiling. Carpenter did cabinetry. Deductible is 10,000 on a Master policy. Manager said – not enough damage (6-7000). There is no unit owner insurance. Is there a chance to get new kitchen through insurance?

If you did not purchase an insurance policy for your unit and the master policy will not cover it – No.

You will have to pay out of pocket to fix your kitchen.

Now you know why it’s so important to purchase a condo policy.

Ok my roomate and I were looking fror a new apt. because our lease is up atthe end of March. We found a guy who was trying to rent a town home for someone. He works for a leaseing agency here in Richmond. We really like the townhome so he said we could put down $ 200 to hold it so he could take it off the market while we were waitng to hear if we were approved.

Well we were denied do to our income not being 3 times the rent. Well he then showed us a different apartment he had in a bad area… So we told him we would think about it and get back to him by monday. This was Friday. Well he was kinda creepy.. right after we left meeting with him he got my number off the app. started texting me… personally not about the apt. I just figured he was being friendly. He kept texting me everyday until we met again. just simple stuff like “have a wonderful day doll” as if we were friends. I didn’t think too much of it cause he seemed like he didn’t have too many friends and I just figured he was just being friendly. Well Monday we told him we would comesign the lease Tuesday.

He then started asking weird questions and becoming more creepy… So my roomate and I became unsure of him and the apt. so we went and looked at a few more places with other realaties. We found something so much better and in a safe area, bigger and way more professional and clen… just a better place. So we called him this moring prior to when we were suposed to meet him and told him we were not going to take the place and we wanted our $ 200 back.

The $ 200 was to hold the town home we DIDN’T get .. then when we said we would go to the other place he used it to hold that place when we didn’t even tell him to. Well today he said thats fine that we don’t want it but it makes him look bad so he isn’t giving us our money back. He has to give it back right? This was a refundable hold dep. & we never signed a lease or anything. He said that someone else wasnted the apt. this morning and he turned them down cause we were suposed to take it, so we caused him a sale…WE DIDN’T EVEN CHOOSE A SPECIFIC APT. WE JUST SAID THAT COMPLEX CAUSE HE SAID THERE WERE PLENTY AVAILABLE!! SO HOW COULD THEY WANT “THE ONE WE HAD” WHEN WE NEVER CHOSE ONE… BUT it would be the same as when you put the money down to hold it while your waiting to be approved and it’s taken off the market and if your not approved you get it back… So my question is are we entitled to the money back ?? I belive we are but now he is refusing to give it backsaying that will make him look bad and he already deposited it into his bank account… any suggestions would be greatly appricated.

Did you write a check to the leasing company or did you give cash to this guy? If you wrote the check to the leasing company and you were denied because of your income level then they should release the deposit back to you. If you gave the “creep” cash and he did not give you a receipt from the company then you just committed a fatal error. Complain to the management and they may fire the bum or get you your money.

My boyfriend and I moved into an apartment in Omaha, NE owned by BH Management out of Dallas, TX. We have had numerous problems, which have been addressed verbally in messages, in person, and by email to the management company (both on property and in Dallas)…

1.) Noise continues to be a problem. Neighbors throw parties. People come home drunk and yelling at all hours of the night.
2.) A neighbor threatened to beat me up and called me a bunch of names while I was in my apartment and while she was standing outside 3 stories down.
3.) There is a poop box on the first floor and it does not get cleaned regularly, therefore the entire apartment complex smells like doggie poo.
4.) Someone has been breaking into our mailbox and taking our mail.
5.) Cigarette smoke from our next door neighbor comes in through the bathroom vent and stinks up the entire apartment.
6.) Nearly everything we touch breaks – VERY OUTDATED.
7.) Our air conditioner does not work to satisfaction. The bill is 150.00 per month. We use energy safe bulbs, keep the air at 76 degrees, and rarely use electronics.
8.) Parking. For several weeks we have had parking issues. We’ll come home at night to find that there are cars we’d never seen before and no parking.
9.) DRUGS – The neighbors smoke narcotics and it comes up through our vents.

I am positive that with all of these issues and with the complaints that we have made and that nothing has been taken care of that we can easily get out of the lease. I just want to guarantee this, can you please help me word our lease…

There’s no way to guarantee that you can get out of the lease without knowing the termination language and how it’s written. Leases are written to protect the LL and not the tenant, chances are none of the items you list are considered reasonable excuses to get out of your lease with the complex. Parking is definately not one of them that’s a risk you take, poor ventillation, the AC bill etc. If your unit was rendered uninhabitable then yes, you’d have a legal and legitimate reason to break your lease, the items above are not them. If someone is breaking into your mailbox and stealing your mail then have it routed to a secure mailbox at the post office, also you need to report this to the post office so they can do something about it, it’s called mail theft and it’s illegal.

The landlord can and will make you pay thru the end of the lease term if you break it. You could be liable for a lot more too.

Your only option is wait until you’ve reached the end of your lease give appropriate notice and move.

I wish to post in a place where others can be warned of this place.The management staff is none responsive and rude they do respond to maintenance problems without formal complaints such as certified letters.The property is being being remodeled in a purely cosmetic way.In one two week period the water stayed off 4 days with no response from managentmentor no apology and no the city was not at fault the whole complex. was without running water or sewage.
I want ot post where future renters or even buyers can learn as what to expect from this terrile property owner and manged complex.
The pamplet I have says it is Managed by Carlise Apt., Inc and the property is called Willow Brook town Homes North.
