Question : Should the landlord have the home inspected before renting to tenants?
I am currently renting the upstairs section of a 2 family home. I have asked that my landlord provide me with proof that the house has been inspected. However, he has not provided me with anything. I really don’t think the house has gone through inspection because we moved in right after he purchased the home and I don’t remember anyone coming to inspect the home. It was a foreclosed home so I doubt if he got the inspection done before we moved in. Is it illegal for him to rent this house to tenants without a professional inspection being done? If there is a law against this please tell me where I can find that information. I am located in the state of MI. Thanks!!!

Your landlord is only responsible for providing a safe and hazard free place for you to rent. Usually an inspection is done when purchasing a home through conventional methods. However, if it was a HUD home (the government insured the loan, the owner defaulted on the loan so now the government paid the mortgage off and owns the home), an inspection is not required. Also, the inspection would have been ordered by the lender and done before closing.
Legally your landlord does not have to provide you with a home inspection since you are not purchasing the property. An inspection covers things like the roof, plumbing and structural damages. You don’t state why you want an inspection but if you find any hazardous conditions you need to document them immediately. Take pictures, get wittnesses if you can and note the date and time. Be sure to present this to the landlord. Remember though, they are only responsible for making sure it is safe and hazard free.
So basically, it is not against the law for your landlord to rent a place without a home inspection and the inspection would have been ordered by his lender prior to closing.
