My Condo Association having major financial problems. I received a letter from the local water Company indicating our water bill behind 60 days in payment if payment not received are payment arrangement are made a lien will be placed on my property along with all the other owners in the building.
The problem is the board member and management co handling of delinquent owners who are not paying their condo fee. I am in the process of trying to move and need to sale my condo because of the delinquency problem, possible lien being place on my unit for none payment of water bill I can not put my unit on the market..
My condo fee’s are current and paid as agree, I need to know my legal recourse’s. My condo in Washington DC. Thank you

While you fees maybe up to date, you are not an single property entity but just a part of the single entity the condo complex, as such their is not much you can do legally about the water company placing a lien on the entire complex and your unit for outstanding bills,
This is the joy of living in a condo, you and all you condo owners are dependent on each other to fulfill their obligations if some do not it falls upon the others to take up the slack,
In your case in this market those condo owners delinquent may not have the funds, so what can your condo board do? One can not get blood from as stone
Also beware in this current credit crunch, any buyer will have to place 25% down most likely and that’s if they find a lender willing to loan into a condo complex, this assumes all liens have been satisfied until then no way you can sell the unit except for a cash only buyer
Summon an emergency board meeting today and demand a plan of action. If the board directors give you hard time, rally all homeowners who are current of the bills and run for president of the board yourself.
The association can amend bylaws by voting. I’d suggest the following course of actions (all must be voted and approved by the board):
1. Notify all delinquent homeowners that the amounts are due in full in 24 hours. List the numbers of payday loan companies and local loan sharks (who break legs) as excellent ways to get the money.
2. All owners who still owe money after 24 hours get their water disconnected, get all privileges revoked such as use of trash, community pool, club room and parking.
3. If the association pays homeowner’s insurance, let them know that they’ll be excluded from coverage the next billing period and their mortgage company notified.
4. The association will place a lean on the delinquent units.
5. The reinstatement of services will come with a steep fine (start at $ 1000)
6. There will be a special assessment to pay the water bill to all homeowners. The homeowners who pay the special assessment will be reimbursed by the delinquent morons at the maximum legal interest rate your state allows to charge.
