I didn’t know home owner insurance handles that. Because you have mold it doesn’t mean that the seller knew it was there. They are only required to tell you about things they know about (and half the time… we know the sellers really do know these things and don’t disclose them because they just want to sell, the dishonesty!) . Do you have escrow, if so I believe you could use that to resolve newly found issues that were apparent during the selling.
I just found out the tiles on my basement floor are asbestos. Home inspector didn’t realize that! How great is that! The joys and heartaches of buying a home. I wonder if my home owners insurance would cover that. I’ll have to check that out. Great question!
Definitely get that checked/fixed it’s could be serious!

If it is really bad, like continuous mold for more than 24 feet exposed, then yes you need to talk to a real estate lawyer, if not, sorry that kind of thing should have been solved during due diligence, that’s what it’s for. Now if it is not exposed but you can prove that it was purposely covered up, like streaks on the drywall, where you can see its been scrubbed, new pieces of drywall covering up moldy pieces, anything like that you also have a case, but again this is stuff that usually is solved during due diligence.

Homeowners won’t handle this, mold isn’t covered. It’s specifically excluded.
You’ll have to hire a lawyer, and sue the prior homeowner for nondisclosure. You’ll have to prove that they KNEW the mold was there, AND that they didn’t disclose it on the sellers disclosure statement. The second part is pretty easy . . . the first part is pretty hard, as ALL homes have mold; most mold is NOT the toxic stuff that scares everyone, and ‘serious’ is subjective.
