Question : I am disabled and live in Virginia. Can anyone help me force my husband to pay the agreed spousal support?
Hi. I am in a bind and seriously need to find someone who can help me. I am not looking for a handout. I am permanently disabled and last year I found out my husband of 12 years had fathered a child the year before. I was devastated. During the weeks the child was conceived I was in UVA with a major heart attack. I filed for divorce as soon as I could scrape together the money the lawyer asked for. She drew up an agreement that we both signed. In the agreement I relinquished ownership of all motor vehicles including 2 financed trucks that I was cosigner on. Also, I gave up 2 drag race cars that we owned jointly. Admittedly, I was still in shock and extreme emotion distress over my life being turned upside down so suddenly. I honorably stood beside everything I had agreed to. I gave him chances to do the right thing and also stand by his obligations as drawn up in my lawyer’s agreement. He was supposed to keep me covered under his health insurance until the divorce was final. He dropped me a month after the document was drawn up. That was 11 months ago. He also agreed to a VERY reasonable spousal support payment of 700.00 a month. My lawyer encouraged me to ask for 1100.00 saying that according to his income that was the calculated amount but I tried to be fair about it, hoping he would pay if the amount was a little more reasonable. He paid 5 months. I have not gotten a dime since March, and that wasn’t even the full amount. I have paid for both halves of the divorce just to get it finished. I have sold EVERYTHING I own except for my home which I make the mortgage on out of my disability check. Including the mortgage, electric, phone and homeowner’s insurance I pay out more a month than I make. I have exhausted all local financial help and cannot afford a lawyer’s help in forcing him to pay me. PLEASE…someone tell me what the correct thing to do is. I desperately need that money. I am behind in the mortgage and can barely afford food and get no help because I couldn’t have children. If you need more information I would tell you whatever would help you to help me. I am desperate. Thank you for any help I get.
Last night he threatened to kill me. That was new. Also informed me he would rather sit in jail than pay. I am inclined to believe him. I HATE that he could just get off scott free for everything..the money, the cheating, the threats. But I’m even in more doubt now that I can do anything and even though no one else would EVER suspect I am afraid. After 13 years I have seen him do some VERY violent things. I got a restraining order this morning but lets face it…that only protects you so much.
