Question : can my aunt have people live in her house and pay rent with out a co in nj if she lives there also?
my aunt is 75 and facing losing her home so she has opened a few of her rooms to tenants and they give her money every month. my question is doesn’t she need a co and an inspection for this in the state of NJ? She resides in the house. but she has a couple living there with small children that they do not watch very well and i am afraid that if one of them gets hurt or worse god forbid that she could be in trouble. what should she do.

Generally with owner occupied property there are few if any restrictions on renting out part of it, other than occupancy. Can’t overpopulate the house! She should have some sort of written agreement or lease with these tenants, setting out what space is exclusively theirs, what space they share, what the rent is, who pays utilities, and any responsibilities they have, like mowing the lawn and shoveling the snow. Can specify that children are NOT to be left unattended in yard or house, etc. Can further state that auntie is NOT responsible for children or tenants, or injuries to same. Rules are important to make this work!
Keep an eye on things and help your aunt out.
She should also check with her insurance company. They might not want to insure her home, or they have a different kind of policy for people in her situation.
