I have a drivers permit only. I have Insurance and registration is all up to par. I was pulled over by the CHP Coming home from work, I wasn’t speeding. However since I did not have a valid license only a permit they impounded my car for 24 hours and said to appear in court. I’m scared that I will be facing a few days in jail which I deserve for my poor actions
I am over the age of 18 and first time ever getting into trouble or a ticket this is the first. Please give me advise or if I should seek a lawyer and get ripped off. I plan to plead guilty ignorance an stupidity. but also it was only to go to an back from work in order to pay the mortgage. I didn’t have a vaild driver to drive me at that hour it was the first time I didn’t listen to the law

you can never go to jail for an infraction. dont pay it or miss a court date then you will. they will just fine you and put you on driver probation.
A violation of Veh C 12500 can be charged as a misdemeanor or an infraction, but driving in violation of the restrictions on a provisional license (which is what it is called, not a permit), is NOT a violation of Veh C 12500. It is a violation of Veh C 12814.6, which is punishable only by a fine or community service.
I don’t know of any law which permitted them to impound your car. It is also unlawful for them to pull you over solely to see if you are violating the restrictions (Veh C 12814.6, subd. (d)).
