Question : My friend bought a home with no home inspection 3 months ago now she sees major repairs. Can anything be done?
We live in Georgia. My friend used her boyfriend as and her relator and he was fairly new in the business. She found a home that she liked and they put a contract on it. Her relator did not tell her to get a home inspection and this was her first home so she didn’t know. She closed on the home and has been living in it for about 3 months. She started seeing problems with things and had a guy come out to look at it. He told her there were several major problmes and he wrote up an estimate for about 10K. The home has problems such as leaking from the roof, the floor boards need replacing, there is mold in the house and the furnace needs replacing. The seller didn’t even provide a disclosure to her. Being that she bought the home basically as is, is there anything that she can sue the seller for? Who should she call to get this resolved?

Her only recourse would be to sue her boyfriend/realtor and his broker.
The realtor was incompetent. That’s sufficient reason to complain to the state licensing agency.
The boyfriend’s broker is ultimately responsible for the actions of his agents. The broker probably has errors and omissions insurance to cover these things.
And her relationship with the BF is probably going to end quickly and badly. But it needs to be done anyway.

There should have been a seller’s disclosure form filled out and she should have a copy. This has to list any defects which the seller KNEW about at the time the house was listed for sale. There should have also been a form which she signed stating that if a problem arose, she elects to work things out with the seller or she may take legal action. Go through the paperwork she received and find these items. In the meantime she should have her realtor contact the listing agent and mention these items. 3 months may be a problem, but if you can prove there was a problem that the seller didn’t disclose, then she has a good case. Have her find an experienced realtor next time.

Every state has its laws that can help out people who are in the circumstanses that your friend is in.
Have them contact state officials that have to do with home inspections and ask for the manager of the department.There will probably be grounds for a lawsuit and your friend will need Big Brother behind them for leverage.

Have your friend check with a local real estate lawyer to see if a disclosure is required in your state. If it is then the realtor that listed the property could be liable. The only time the seller could really be liable would be if they lied on a disclosure about existing problems but you stated no disclosure was presented at all. Sometimes things are missed in deals and it’s unforunate that her boyfriend, the realtor, missed something as crucial as a home inspections. Sometimes it’s better to get a second opinion on major transactions, that is the reason that agents work under more experienced brokers. Tell your friend good luck.

I do not know it in Georgia, but in texas seller and realtor have to disclose the defect if any when they are selling their house. realtor shoud tell her client to get inspection, realtor did not do her job. probably realtor know the problem, like they said do not ask, do not tell. please check her contract about home inspection, who need to do it. you also can report realtor to the state who is regulate realtor, also let realtor to know, she screw something up. please check your attorney friend, there are should something to be done in this kind case. and good luck.
