Question : Home warranty issue…dishonest previous owner, help!?
My husband and I purchased our first home one month ago. We have a home warranty on it. The washing machine, included with the house and under the warranty plan, flooded the kitchen (it’s in a room next to the kitchen). I called the previous owner to see if I was doing something wrong, he said it was fine and always worked for him. The day we moved in, I started using it and it leaked a little each time. Well, i made the mistake of telling the warranty company this and now they won’t cover it since it was pre-existing if it had leaked from day one, which it did…it just got really bad yesterday. Now what can I do? I think the previous owner may not be being honest, and it wasn’t working. What can I do? The warranty company told me it sounded like the previous owners weren’t honest and didn’t disclose it, so should I call my realtor and see what to do? I am so mad…I have a husband and a two year old who got sick yesterday and vomited on every bath towel I own. Help!

When you had your inspection, the inspector should have noted the condition of the washer and THAT can be used as proof of the problem not being pre-existing.
If you didn’t get an inspection, well, you’ve just learned a very valuable (and costly) lesson in life – and will be purchasing a new washing machine out of your own pocket as a penalty for not forking over the couple hundred dollars like you should have.
Laundromats will be your best friend until you can get a new washer I guess.
Sorry, but you took a gamble and lost this time. It happens.
house is sold as is, sounds like you made a mistake of not having a home inspection before closing escrow, go down and buy a new washer and be done with it
