Question : Can I sue the previous owner of my house if they lied about termites on the disclosure notice?
Yes I had a “visual pest inspection” before I bought it. They did do some remodeling and paint to cover these areas. I have a quote from back in 2008 when they found out they had these termites, now the damage is 10x worse and will cost at least 10,000 for getting all this fixed. What are my legal rights?

No. You get an inspection before closing the sale as a matter of routine to make things like this a non-problem. Since you had an inspection, there should be a warranty included from whoever did the inspection.

The list of suspects include the former home owners and the building inspector. Both may be covered by some kind of insurance policy. The building inspector may has a limited warranty but could try to avoid liability by saying “I did not see any termites.” In court you would need the testimony of another building inspector to show the first guy did not do his job. It would be best to talk with a lawyer to find out your rights, your options and the likely outcomes arising form your different options.

If your state has a mandatory disclosure rule, and if they disclosed that they were unaware of any termites, and if you can prove that they were in fact aware of termites and intentionally lied on the disclosure form, then your state probably provides for a suit for damages from the non-disclosure. I do not know what state you are in and I do not know what you can prove, but I hope this helps.
