How can Police charge my son with aggravated burglary when evidence doesnt fit the crime?
Question : How can Police charge my son with aggravated burglary when evidence doesnt fit the crime?
My son was caught trespassing but Police charged him with aggravated burglary just because they saw wet footprints leading to a metal storage building. Nothing was in there but cleaning supplies and a toilet. And my son certainly had no weapon. Why are they being so hard on him? He has no former record of anything.
Please help me help him. Thank you

Because they are 3rd party non biased parties in the incident. You are a very biased mother. Your son may not be telling you the truth about what has happened. You were not there when they arrested him. Get a lawyer and plead it down or have your day in court and throw the dice for an educated jury.
Yes they can charge him. Now weather or not that particular charge makes the court room is another story.
