Your agent should have taken care of this.
A home warrenty is not required, it is part of the sales package. You need to read both the offer you signed and your sales agreement.
Your RE agent will get involved with this, and their E and O insurnace should cover this. You should not be sued directly, this is one of those things you hire a RE for.
I do not know of any state that requires that the seller provide a home warranty. There are some states that require the seller/contractor of new construction to provide a one year home warranty, but even that is not a complete home warranty.
In my area, a home warranty is less than $ 500 for a basic policy, it may be worth it to pay to make this go away, which is why some {insert inappropriate comments here} sue rather than negotiate.
