Generally speaking, the builder is responsible for structural defects. Before getting a certificate of occupancy, all the proper inspections should have been done. Contact your local government building dept and ask them. They will know.
Builders warranty typically only covers the main structure, unelss it was negotiated into the warranty as part of the package.
