A contractor has been doing a reconstruction of my house, which had a fire in Apr. ’05. Nearly two years later the work has not been completed althoug the city has signed off the last inspection. I have no more money at this moment and the contractor still needs to finish quite a bit of work per what we agreed upon. He is now demanding payment after I have provided him with over 82% of the pay. The work has been really slow, with completion not really in the near future due to his work ettiquette. I told him that I had no money at this time, which I don’t, since he took so long to do the work, I had to pay bills and continue the mortgage payment as well. He said that he was going to place a lien on my home, can he do that? Is it possible to do this in San Diego, California? The mortgage company gave me a document that said there were not going to be any liens placed on my house and he signed it. Can anyone advise on this issue?

The short answer is yes, he has the right to put a lein on your property. Contact a lawyer immediately for professional advice.
He can, and he does NOT have to wait until the house is completed. He is not compelled to continue working if you are late with a payment. It is horrible, and unfair, but that’s how it goes. You have to sue him and win to have the lien removed against his will.
